On August 29, the "Environmental Protection Tax Law of the People's Republic of China (Draft)" was submitted to the 22nd meeting of the Standing Committee of the 12th National People's Congress for deliberation. According to the draft, China intends to levy an environmental protection tax and use the current sewage charges as the lower limit of the environmental protection tax.

In the explanation of the draft, Minister of Finance Lou Jiwei said that this legislation is based on the principle of “transfer of tax burden†and shifts the current sewage charge system to the environmental tax system.
The Environmental Protection Law (Trial) promulgated in 1979 established a sewage charge system, which was continued by the current environmental protection law. The NPC Financial and Economic Committee believes that compared with the tax system, the sewage charge system has problems such as insufficient law enforcement rigidity and local government and department intervention. Therefore, it is necessary to change the environmental protection fee.
According to the draft, taxpayers of environmental protection tax are enterprises and institutions and other producers and operators who directly discharge pollutants to the environment in the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China. Taxable pollutants are atmospheric pollutants, water pollutants, solid waste and noise.
How to link with the sewage charge system, the draft stipulates that each vent or non-venting taxable atmospheric pollutants should be sorted according to the number of pollution equivalents from large to small, and the environmental pollution tax is levied on the first three pollutants; Taxable water pollutants shall be sorted according to the number of pollution equivalents from large to small. The heavy metal pollutants shall be subject to the environmental protection tax according to the first five items and other pollutants according to the first three items.
The draft regards the current sewage charge rate as the lower limit of the environmental tax, which stipulates that the air pollutant tax is 1.2 yuan per pollution equivalent; the water pollutant is 1.4 yuan; the solid waste is different according to different types, and the tax amount is 5 yuan to 1000 yuan per ton; The noise is in excess of decibels, and the tax amount is 350 yuan to 11,200 yuan per month.
Taking into account the large differences in local conditions, the draft authorizes the provincial people's government to increase the applicable tax amount of taxable pollutants on the basis of the tax standards stipulated in the Environmental Protection Tax and Taxation Schedule, and report it to the Standing Committee of the same level for decision. Luo Jianhua, secretary-general of the Chamber of Commerce of the National Federation of Industry and Commerce, said that China's proposed legislation to levy environmental protection tax indicates that the state's awareness of environmental protection is more clear, which will certainly promote enterprises to focus on pollution prevention while developing production. This is a positive incentive. Of course, it is only a transitional plan. The most ideal state of using tax leverage to stimulate development is that the tax rate is higher than the governance cost, thus increasing effective incentives.
Industrial pollution control is expected to expand

In Luo Jianhua's view, a positive incentive mechanism should be formed. In addition to penalizing heavily polluting enterprises, companies that are doing well should be encouraged, such as tax halving and environmental leader systems, and they must have a big stick and carrot policy. .
The draft clearly states that in order to encourage enterprises to reduce pollutant emissions by adopting advanced technologies, the taxpayer's emission of taxable air pollutants and water pollutants should be less than 50% of the national or local pollutant discharge standards, and the environment should be reduced by half. Protection tax.
Luo Jianhua believes that compared with municipal environmental protection, the introduction of environmental protection tax will attract enterprises to explore the field of industrial pollution control, which is much larger than municipal environmental protection.
